1. Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.

2. During the course of arguments, it is brought to the notice of this Court by the Learned Counsel for the respondents that a Three-Men Committee was constituted for fixation of the rent

Patna High Court CWJC No.3550 of 2023(5) dt.06-07-2026 2/3 payable for utilization of the petitioner's hotel as a Quarantine Centre during the lockdown period at the time of the COVID-19 pandemic. The said Three-Men Committee fixed the rent at Rs. 400/- per room. It is further submitted that the order of the Committee, annexed as Annexure-A to the counter affidavit dated 18.10.2022, has not been challenged by the petitioner.

3. At this juncture, the Learned Counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to challenge Annexure-A annexed to the counter affidavit. He further seeks liberty to produce all the relevant documents relating to the expenses incurred in running the Quarantine Centre during the COVID19 pandemic.

4. Considering the aforesaid facts and circumstances of the case and the submission of Learned counsel for the petitioner as well the Learned counsel for the respondents, the petitioner is permitted to challenge the order of the ThreeMen Committee i.e., Annexure-A to the counter

5. With the above said liberty, the present Writ petition is dismissed as withdrawn.
