5/5 11-11-2022 This application has been filed for restoration of Civil Revision No. 421 of 2005.
This civil revision application was preferred against the order dated 29.11.2004 passed by 5th Additional District Judge, Rohtas at Sasaram in Title Appeal No. 31 of 1984. No one appears for the petitioners.
On 15.11.2019, the defects were pointed out by the office but no one had appeared for the petitioners. Accordingly, the petitioners were granted four weeks time to remove the defects. No purpose will be served by keeping this application pending.
This application is dismissed with a liberty to the petitioners to file a fresh application in accordance with law, if the cause of action still survives and Title Appeal No. 31 of 1984 is still pending. The limitation in filing the second application will be considered in view of the pendency of Civil Revision No. 421 of 2005 and the restoration application. With the aforesaid observation and direction, this application is dismissed.
