JUSTICE ASHUTOSH KUMAR ORAL ORDER 27-02-2019 The petitioners seek bail in anticipation of their arrest in connection with Pear P.S. Case No. 204 of 2018, dated 01.11.2018, instituted for the offences under Sections 341, 323 and 506/34 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.

Three persons are said to have been arrested

Patna High Court CR. MISC. No.11762 of 2019(2) dt.27-02-2019 2/3 by the members of the public for having threatened the informant for not giving biscuits. The aforesaid three arrested persons have named the petitioners as their associates.

The learned counsel for the petitioners has submitted that but for the confession of the arrested accused persons, there is no other material to connect the petitioners with the offence.

The petitioners have clean antecedents and there has not been any recovery of any firearm from them.

Considering the aforesaid facts, the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class,
