JUSTICE SANJAY PRIYA ORAL ORDER 02-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kotwali P.S. Case No. 313 of 2016 instituted for the offence under Sections 25(1-B)a, 25(1-AA) and 35 of the Arms Act.

It has been submitted that petitioner is not named in the written report. His name has been disclosed by the Spy and, thereafter, he has been arrested by the police. As per written report, while vehicle checking was going on by the police, three persons riding on a Glamour motorcycle came and on seeing the police party, they fled away leaving the motorcycle. On search, police recovered 32 pieces of semi made pistol from the motorcycle which was kept in a bag. It is mentioned in the impugned order itself that

Patna High Court Cr.Misc. No.19090 of 2017 (2) dt.02-05-2017 2/2 paragraph-66 of the case diary reveals that accused has confessed his guilt before the police. It is also mentioned in the impugned order that name of the petitioner has been disclosed by the Spy. The seizure list enclosed with the written report, does not bear the signature of the petitioner.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Kotwali P.S. Case No.313 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
