This application, for grant of anticipatory bail, arises out of Sono (Charkapathar) Police Station Case No. 108 of 2019, disclosing offences under Sections 341/323/308/504/506 of the Indian Penal Code.

The allegation against the petitioner is that the petitioner assaulted the informant by means of axe. Learned Counsel for the petitioner submits that both the parties are agnates and there is land dispute between them. He also submits that the incident has taken place on a trivial issue inasmuch as the cow of the informant had entered into the filed of the petitioner for grazing. He, referring to Annexure-2,

Patna High Court CR. MISC. No.10687 of 2020(4) dt.01-07-2020 2/2 submits that injuries caused to the informant have been found to be simple in nature.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that both the parties are agnates, there is land dispute between the parties and the injuries sustained by the informant have been found to be simple in nature, I am inclined to grant the petitioner privilege of anticipatory bail.

This application is, accordingly, allowed.

Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Jamui, in connection with Sono (Charkapathar) Police Station Case No. 108 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
