The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code.

As per the prosecution case, it is stated by the informant that he received information about the murder of his mother. He further states that he has no enmity with any person. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation. While suspicion was raised against him, neither there is any eye witness to the occurrence nor any incriminating material has transpired to connect him with the alleged crime. He is in custody since 14.12.2020 and his case stands on a similar footing to that of

Patna High Court CR. MISC. No.22123 of 2021(3) dt.17-11-2021 2/2 accused Dhananjay Thakur who has been enlarged on bail vide order dated 24.8.2021 passed in Cr. Misc. no. 18867 of 2021 and accused Brajesh Thakur and Ghanshyam Thakur who have been enlarged on bail vide order dated 6.9.2021 passed in Cr. Misc. no. 20335 of 2021.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with grant of bail to the above mentioned co-accused, the petitioner not having any criminal antecedent and being in custody for more than 11 months, the Court directs the petitioner to be enlarged on bail in connection with Banka P.S. Case no. 64 of 2005 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka.
