JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-03-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Paliganj Police Station Case No. 142 of 2014, disclosing offences under Sections 302/201/34 of the Indian Penal Code.

The deceased was married to the brother of the wife of the present petitioner in the year 2004. The deceased died on 27.06.2014.

It is alleged that the husband of the deceased and his family members used to torture the deceased and make demand for dowry.

Learned Counsel for the petitioner submits that the petitioner has been implicated only because he is

Considering the nature of allegation against this petitioner as leveled in the First Information Report, this application is allowed.

Let the petitioner, Nanda Ram, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Danapur, Patna, in connection with Paliganj Police Station Case No. 142 of 2014, subject to the condition laid down under Section 438

(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
