2. The petitioner has prayed for the following reliefs: (i) for issuance of a writ in the nature of Mandamus directing the concerned respondent authorities to construct the Panchayat Bhawan at the appropriate place which is
2/4 suitable for the villagers and which has been recommended by the Panchayat for construction of the Panchayat Bhawan, however, the concerned respondent authorities for the reason best known to them are hell bent on constructing the Panchayat Bhawan at a different place which would be causing inconvenience to the General Public;
(ii) for setting aside the order dated 16.03.2023 passed by the Collector Muzaffarpur and signed by the Additional Collector, Muzaffarpur by which the land bearing Khata No.300, Khesra No. 1335 area-52 decimal has been directed to be transferred to the Panchayati Raj Department;
(iii) for further to stay the operation of the letter no. 3286 dated
3/4 02.11.2023 which relates to the Panchayat of the petitioner by which the Collector had provided the relevant information to the Additional Chief Secretary, Panchayati Raj Department for construction of the Panchayat Bhawan at Khata No. 300 khesra no. 1335;
(iv) for further to direct the concerned authority not to proceed in view of the order of the District Magistrate dated 16.03.2023 by which he has ordered for transfer of the land bearing khata no. 300 khesra no. 1335 area 52 decimal to the Panchayati Raj Department and not to start construction;
(v) for directing the concerned authority to follow the direction issued by the Chief Secretary, Government of Bihar vide letter no.
4/4 281 by which it has been directed that the land as far as possible should be near to the road and the population so that the General Public can avail the facilities;
(vi) for other necessary relief/reliefs to which the petitioner may be found entitled to in the facts and circumstances of the case.
3. Learned counsel for the petitioner submits that he shall be approaching the respondent no.1, the Principal Secretary, Panchayat Raj Department, Bihar, Patna for the redressal of the grievance.
4. The said liberty is granted without making any comment on the merits of the case.
5. The writ petition stands disposed of.
