2. The petitioner seeks regular bail in connection with Sessions Trial No.2 of 2025 arising out of Patarghat P.S. Case No. 125 of 2024 lodged on 18.06.2024, for the offence punishable under Sections 25(1-A), 25(1-B), 25(1-AA), 25(1B)a, 26 & 35 of the Arms Act.
3. As per the prosecution, FIR has been lodged against three named accused persons including the present petitioner. It has been alleged in the FIR that upon secret information, police reached at the place of occurrence and two persons were caught (including the petitioner) while one person fled away. On search, a huge quantity of arms and ammunitions alongwith machines for making arms were recovered from the petitioner's house.
4. Learned Counsel for the petitioner submits that petitioner is innocent and has committed no offence. Counsel
Patna High Court CR. MISC. No.12877 of 2025(2) dt.11-04-2025 2/2 submits that nothing has been recovered from the petitioner's possession. Counsel submits that co-accused person namely, Amar Mandal has been granted bail by this Court vide order dated 03.10.2024 passed in Cr. Misc. No.72222 of 2024. Counsel further submits that the criminal antecedent of the petitioner is not clean as there are six cases pending against him and in all the cases, he is on bail. The petitioner is in custody since 18.06.2024 and he is ready to fulfill all the conditions whatsoever shall be imposed upon him.

Learned APP for the State opposes the prayer for bail of the petitioner and submits that co-accused person to whom bail has been granted by this Court was not arrested from the place of occurrence and also has no criminal antecedent while the present petitioner has six criminal antecedents. Counsel further submits that the articles which are being used for construction of desi katta/gun were recovered from the petitioner's house.
6. In the present facts and circumstances, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for regular bail of the petitioner is hereby rejected. (Dr. Anshuman, J) Divyansh/- U T
