It has been alleged by the informant that on the pretext of fire arm appellant succeeded his entrance inside her house where he teased her daughter Sobha Kumari. He was apprehended but succeeded in his escape.

As per para-3, appellant has got no criminal antecedent and he is under custody since 24.10.2014.

Consequent thereupon, setting aside the order dated 21.1.2017 passed by the Additional Sessions Judge-1st , Khagaria in G.R. No. 1367 of 2016, appellant Fekan Mahto is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Session Judge-1st, Khagaria in

Patna High Court CR. APP (SJ) No.789 of 2017 (4) dt.03-05-2017 connection with G.R. No. 1367 of 2016 arising out of Chautham P.S. Case No. 81 of 2016.

This appeal is allowed.
