JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-03-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Kadwa Police Station Case No. 141 of 2013, disclosing offences under Sections 302, 120B/34 of the Indian Penal Code.

Considering the submission that no case under Section 302 of the Indian Penal Code is made out in view of the allegation contained in the First Information Report and in similar circumstance, co-accused Md. Nadeem has been granted anticipatory bail by this Court vide order, dated 18.02.2016, passed in Criminal Misc. No. 3207 of 2016, this application is allowed.

Let the petitioner, Bishwajeet Rai @ Pinku, in

Patna High Court Cr.Misc. No.5970 of 2016 (3) dt.10-03-2016 2/2 the event of his arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Kadwa Police Station Case No. 141 of 2013, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
