The petitioner has preferred this application for grant of regular bail in a case registered under sections 354D and 506 of the Indian Penal Code and section 14 of the POCSO Act. As per the prosecution case, allegation against the petitioner is of having misbehaved with the minor daughter of the informant and of having uploaded her photograph on the facebook.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. For the allegations, as alleged, the petitioner has remained in custody since 24.5.2020 i.e. for a period of about 1 year 6 months. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the period in custody, the Court directs the petitioner to be enlarged on bail in connection with Special Case no.14 of 2020 (arising out of Fulkaha P.S. Case no.57 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge, Araria.
