The petitioner apprehends his arrest in Srinagar P.S. Case no. 70 of 2014, registered for the offences punishable under Sections 376, 511, 448, 323 of the Indian Penal Code. The prosecutrix made allegation that the petitioner entered into her house and committed rape with her. It is submitted that the petitioner is the neighbour of the informant. There is some dispute with regard to flow of drainage. The petitioner was brutally assaulted. The police after investigation submitted charge-sheet under Section 354 and other Sections of the Indian Penal Code.

Considering the facts aforesaid and the fact that the petitioner is alleged to have tried to outrage the modesty of the

Patna High Court Cr.Misc. No.14423 of 2015 (3) dt.11-05-2015 2/2 prosecutrix in the night, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
