Patna High Court CR. MISC. No.13092 of 2022(2) dt.05-09-2022 2/3 APP for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 326, 324, 171(G), 307 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
It is a case of assault by means of knife upon the son of the informant as well as shot fired by the accused persons including the petitioners.
It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that there is no specific allegation of assault against the petitioners and the nature of injuries are simple and good sense has prevailed between the parties which is a compromise petition available at Annexure-3 to the petition. Learned APP appearing for the State opposed the anticipatory bail.
Considering the aforesaid submissions, let the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in
