The petitioner seeks bail in connection with Ghorasahan P.S. Case No. 295 of 2016 for the offence punishable under Sections 272, 273 of the Indian Penal Code and 47(A), 53 and 54 of the Bihar Excise Amendment Act. The informant, on secret information, conducted raid at a hut in a vegetable market. Seeing the police party, the petitioner started fleeing away, but he was caught and on search 28 bottles of Nepali Saffi each containing 300 ml. was recovered. Learned counsel for the petitioner submits that the petitioner is a resident of different place at a distance of 48 kms. He had visited the said place to meet his relative and was apprehended by police on mere suspicion.
Patna High Court Cr.Misc. No.11206 of 2017 (3) dt.29-03-2017 2/2 Learned APP, on the other hand, opposed the submissions.
Considering the nature of allegation and the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikrahna at Dhaka/Motihari in connection with Ghorasahan P.S. Case No. 295 of 2016.
