BAJANTHRI ORAL JUDGMENT Date : 13-12-2021 Heard learned counsels for respective parties. In the instant petition, petitioner has prayed for the following reliefs:-

Patna High Court CWJC No.6099 of 2020 dt.13-12-2021 2/3 (i) To lodge first information report against the respondent no. 3 to 12 who all have willingly and knowingly cooperated the respondent no. 8 (Mahesh Prasad) in obtaining the job in L.I.C.

Office Patna on the basis of forged certificate of Scheduled Caste, which has been found forged in inquiry report contained in Annexure-5 and 8 and on the basis of the inquiry report, respondent no.

8 Mahesh Prasad has already been dismissed from the service by the L.I.C.

Authorities, Patna.

(ii) That the respondent no. 14 be also directed to make recovery of entire paid salaries of Mahesh Prasad (Respondent no. 8) along with appropriate interest.

(iii) That the respondent no. 14 be also directed to make recovery of loan amount of Rs. 5 Laksh with appropriate interest taken by the respondent no. 8 Mahesh Prasad as an employee of L.I.C.

(iv) That proper safety of life and liberty of the petitioner be given as respondent no 8 and others have threaten the petitioner to kill, if he will take any action against forged certificate of the respondent no. 8.

(v) That any other relief or reliefs may kindly be granted in favour of the petitioner as it may be deemed fit and proper to the facts and circumstances of this case."

For registration of FIR against Respondent Nos. 3 to 12, the petitioner has a remedy before the jurisdiction police or invoking Section 200 of Cr.P.C. for filing complaint. In the event

Patna High Court CWJC No.6099 of 2020 dt.13-12-2021 3/3 of non-filing of complaint by the LIC, the aforesaid relief cannot be entertained in the present petition.

In respect of other reliefs are concerned, the concerned respondent is hereby directed to take appropriate action in accordance with law. Before proceeding, Respondent Nos. 3 to 12 shall be given ample opportunity to defend their cases. The above exercise shall be completed by the LIC Respondent authority within a period of six months from the date of receipt of this order. With the aforesaid observations, the writ petition stands disposed off.
