Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 30(a), 38(i) and 41(i) of the Bihar Prohibition and Excise Act, 2018.
Submission is that name of the petitioner surfaced in the confessional statement of co-accused. Petitioner is in custody since 02.01.2021. Petitioner has got no criminal antecedent. Petitioner was not there at the time of recovery of liquor. Investigation of the case against the petitioner is already complete.
Considering the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court CR. MISC. No.22355 of 2021(2) dt.27-08-2021 2/2 bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Jandaha Police Station Case No. 247 of 2020, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
