JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner, who is in custody since 01.01.2020 and bears a clean antecedent seeks bail in connection with Special Case No. 02/2020 arising out of Barh P.S. Case No. 627/2019, instituted for the offence under Section 30(a) of Bihar Prohibition and Excise Act, 2016.

44.280 litres of liquor is said to have been recovered from the house of the petitioner.

Learned counsel for the petitioner has submitted that he has been made accused in this case falsely. In fact, the petitioner did not even know that the son who had fled away at the time of raid had kept liquor in his house.

Considering the nature of accusation against the

No.13370 of 2020(2) dt.03-03-2020 2/2 petitioner and his period of custody as also taking into account his clean antecedents, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna In connection with Special Case No. 02/2020 arising out of Barh P.S. Case No. 627/2019.

The application stands allowed.
