The petitioner seeks bail in connection with a case registered for the offence punishable u/s 302, 201, 120B of the IPC.

As per the prosecution case, the allegation against the petitioner is that he, in association with other co-accused persons killed the son of the informant and concealed his dead body beneath sand loaded in a truck.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He has been falsely implicated in this case due to enmity. There is general and omnibus allegation against the petitioner. It is further submitted that the post-mortem report has not supported the prosecution case. There is no eye witness

Patna High Court CR. MISC. No.10765 of 2025(2) dt.28-02-2025 2/2 to the alleged occurrence. Petitioner has been made accused only on the basis of suspicion. Similarly situated co-accused has already been granted bail by this Court vide order dated 24.01.2025 passed in Cr. Misc. No. 85319 of 2024. The petitioner has one criminal antecedent and he is languishing in judicial custody since 18.11.2024.

Learned APP for the State opposed the prayer for bail. 6.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/the Successor Court, in connection with Jehanabad P.S. Case No.463 of 2024.
