The case has been registered under the provision of section 3 (X) of the SC/ST (Prevention of Atrocities ) Act as well as various sections of the Indian Penal Code, out of which sections 354, 379 of the IPC as well as section 3 (X) of the SC/ST (Prevention of Atrocities) Act are not bailable whereas rest sections are bailable in nature.
So far as section 3 (X) of the SC/ST (Prevention of Atrocities ) Act is concerned, it appears that there is bona fide land dispute between the parties and, therefore, application of provision of the SC/ST (Prevention of Atrocities ) Act appears to be doubtful. Considering the aforesaid facts and circumstances as well as

No.9360 of 2015 (3) dt.19-03-2015 submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Biraul at Benipur District Darbhanga in Ghanshyampur P.S. Case no. 05/2013 subject to condition as laid down under section 438(2) of the Cr.P.C.
