JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Mansahi P.S. Case No. 118 of 2018 registered for the offences punishable under Sections 341, 323, 504, 498A of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.
Petitioner happens to be husband of the informant and allegation is that for non-fulfilment of demand of Rs.4 lac he subjected her wife to cruelty.
Submission of learned counsel for the petitioner is that whole allegation is false and concocted and he is always ready to keep her with dignity and care and now a compromise petition has been filed in the court below signed by both the
Patna High Court CR. MISC. No.12919 of 2019(10) dt.15-11-2019 2/2 parties.
Heard learned APP. None appears on behalf of opposite party No.2 in spite of valid service of notice on her. In view of above facts and circumstances, let petitioner surrender in the court below within a period of three weeks from the receipt of this order and on verification of the compromise petition jointly filed by both the parties the court below shall release the petitioner on bail to its own satisfaction, otherwise petitioner has to pray for regular bail.
