JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-11-2021 After some arguments, the learned counsel for the petitioner in presence of the learned Spl.P.P. for the State Sri Binay Krishna, seeks to withdraw the present petition in order to take appropriate steps by filing appropriate petition afresh, inasmuch as the order impugned herein dated 05.02.2020, passed by the Additions Sessions Judge-VIII, Muzaffarpur (arising out of Mahila PS case no. 63 of 2019 under Section 376(D), 341, 323 of Indian Penal Code and 4/6 of PSCSO Act as also under Section 3(I)(R)(R) 2(VA) of SC/ ST Act) was also challenged before this Court in the earlier round of litigation vide Cr. Appeal (SJ) no. 1215 of 2020, however the said appeal was dismissed by this Court vide order dated 03.09.2020, hence the same order cannot be challenged again before this Court. Accordingly, the present petition stands disposed off
