The petitioner seeks bail in Guraru P.S. Case No. 92 of 2016, registered for the offences punishable under Section 353 and other Sections of the Indian Penal Code.

The petitioner and others are alleged to have constructed house on Gair Mazarua Aam when police went to remove the encroachment from the government land the petitioner and others are alleged to have assaulted the police personnel. Learned counsel for the petitioner submits that there is no house of the petitioner in Gair Mazarua Aam. No specific allegation of assault is made against the petitioner. Considering the facts aforesaid and nature of allegations made against the petitioner and the fact that the petitioner is in jail

Patna High Court Cr.Misc. No.12127 of 2017 (2) dt.20-03-2017 2/2 since 28.01.2017, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Gaya in Guraru P.S. Case No. 92 of 2016.
