JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kotwali P.S. Case No. 288 of 2014 registered for the offences punishable under Sections 419, 420/34 of the Indian Penal Code, Section 18, 19 and 10 of Bihar Board Examination Conduct Act. Petitioner applied for the post of constable but in place of petitioner, another person appeared in the examination. Therefore, I do not feel it proper to grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail in connection with Kotwali P.S. Case No. 288 of 2014 pending in the court of Chief Judicial Magistrate, Munger stands rejected.
However, if petitioner surrenders before the
Patna High Court Cr.Misc. No.7955 of 2015 (2) dt.04-03-2015 concerned court within four weeks from the date of receipt/production of copy of this order and seeks regular bail, the prayer for regular bail of the petitioner shall be considered on its own merit without being prejudiced by this rejection order, particularly, taking into consideration that the person who had appeared in place of the petitioner is said to have already been released on bail.
