JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-03-2019 This is an application for grant of anticipatory bail in connection with Katihar Town P.S. Case No. 824 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code.

Allegation against the petitioner and several other accused persons is of assault by fists and slap to the brother of the informant due to which he succumbed to the injury. Submission of learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and the postmortem disclosed that the death has occurred due to neurogenic and hemorrhagic shock resulting from internal injury inside the brain. It has further been submitted that the deceased was suffering from brain tumor and other two accused persons have been granted anticipatory bail

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar, in connection with Katihar Town P.S. Case No. 824 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
