JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-04-2024 The present writ petition has been filed seeking the following reliefs:- "1(i). To consider case of the Petitioner for appointment as Community Health Officer in pursuance to the Advertisement No 2 of 2022.

(ii). To hold that non giving of reservation of 2% to the Petitioner being the grandson (Nati) of

Patna High Court CWJC No.3422 of 2024(2) dt.04-04-2024 2/2 freedom fighter late Mohit Lal Yadav is flagrant violation of specific terms incorporated in the Advertisement No 2 of 2022 referring to the letter no. 2526 dated 18.02.2016 of General Administration Department, Government of Bihar in terms of which in the case of availability of vacant post of 2% reservation was mandatory requirement.

(iii). To hold that non giving of 2% reservation to the heir of the freedom fighter vitiates the whole appointment of Community Health Officer in compliance with Advertisement No. 2 of 2022 issued by the State Health Society Bihar."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to approach the Respondents authorities for redressal of his aforesaid grievances. Liberty, so sought, is granted.
