JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 337, 338, 379 and 504/34 of the Indian Penal Code. The accusation is of assaulting the informant and her nephew and snatching gold chain.
It is submitted by learned counsel for the petitioners that except one injury for which opinion has been reserved, all the injuries have been found to be simple when there is counter version of the occurrence also and petitioners' side also received injury.
Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.10500 of 2015 (2) dt.18-03-2015 2/2 petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Belaganj P.S. Case No. 176 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Since petitioner nos. 1 to 3 have criminal antecedent, learned court below will be at liberty to cancel their bail bonds if they default for two consecutive occasions or get involved in some serious nature of offences.
