JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 376D, 354, 448, 341, 323, 504, 506 and 509 of the Indian Penal Code and 4/8 of the POCSO Act.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that though this case has been lodged under Section 376D and other allied sections of the Indian Penal Code but the allegation against the petitioner is that he allowed the accused to go after taking Rs. 30,000/- from him and also cut the hair of the informant as well as her mother but the aforesaid allegation is not corroborated by the victim in her statement under Section 164 Cr. P.C. Further, there is land dispute between the petitioner and the informant and in
Patna High Court Cr.Misc. No.8533 of 2017 (2) dt.01-03-2017 2/2 order to grab the property, the present application has been preferred against her uncle.

Having heard both sides, in view of the allegation made, petitioner is directed to surrender in the court below, i.e., Additional Chief Judicial Magistrate, Ist, Samastipur, in connection with Tajpur (Waini O.P.) P. S. Case no. 312 of 2016 and thereafter, the court below will release petitioner on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to the satisfaction of learned court below, subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the investigation and make himself available before the police as and when required.
