That this is an application for issuance of proper writ/writs, order/orders, direction/directions to the respondents to immediately vacate the house/premises of the petitioner situated on the North side portion of the First Floor of Radha Bhawan, Belsand, District- Sitamarhi, Bihar measuring an area 624 Sq. ft. comprising One Hall, Four rooms, One

Patna High Court CWJC No.3386 of 2024(2) dt.06-05-2024 2/2 Verandah, One Court-yard (Angan) rented to BSNL in or about 1986 and also to remove Tower, which was installed in 2006-2007 in the vacant land on the North side of Radha Bhawan measuring an area 1307.81 Sq. ft., the Plinth of Tower 20'x30' = 600 Sq. feet, keeping in view, the letter dated 20.09.2022 issued under signature of Sri B.K. Sinha, dated 27.09.2022, D. E. (MS-Tech), O/o G. M. (C.M.), Bihar Circle, Patna to the B.A. Head, Muzaffarpur."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law including that of filing a suit before the learned Civil Court having competent jurisdiction. Liberty, so sought, is granted. 3.

The writ petition stands disposed off.
