JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-05-2017 The petitioner is in custody since 16.08.2016 in connection with Kajra P.S. Case No. 33 of 2016, registered for offences punishable under Sections 304-B/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that petitioner being mother-in-law of the deceased and the case is under Section 304B, however, from perusal of F.I.R itself it will appear that no specific allegation has been attributed to her and she has been in judicial custody for more than eight months. Heard learned A.P.P. also.

Having heard both sides, considering the aforementioned facts and circumstances, the period of custody and also that petitioner is mother-in-law and no specific allegation has been attributed to her, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs.

Patna High Court Cr.Misc. No.19586 of 2017 (2) dt.04-05-2017 2/2 Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Muzaffarpur, in connection with Kajra P.S. Case No. 33 of 2016, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of her bail bonds.
