JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-05-2019 The petitioner seeks regular bail in connection with Jhajha P.S. Case No. 352 of 2018, registered for offences punishable under Sections 302, 120B/34 of the Indian Penal Code.

Prosecution case is that the deceased was called by the petitioner and, thereafter, his dead body was found and informant suspects the hands of other accused persons, who have killed the deceased in collusion with the petitioner. It has been submitted on behalf of the petitioner that there is dispute between the deceased and other accused persons and petitioner is only said to have called the deceased and except that there is no allegation against him and he has been made accused only on the basis of suspicion and he has been in

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jamui, in connection with Jhajha P.S. Case No. 352 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
