JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-01-2022 Heard Mr. Anuj Kumar, learned Advocate for the petitioner and learned APP for the State. The petitioner, who is the mother-in-law of the deceased, seeks bail in anticipation of her arrest in connection with Beur P. S. Case No. 297 of 2020, dated 07.11.2020, instituted for the offences under Sections 304B and 34 of the Indian Penal Code. It has been urged on behalf of the petitioner that she is an elderly lady who has only been roped in the present case because of her relation with the husband of the deceased.

Two of the other accused persons have been granted anticipatory bail by this Court as well as by another Bench of the Court.

Considering the afore-stated submissions, the petitioner, above-named, in the event of her arrest or surrender before the court below within a period of six weeks, is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. III, Patna, in connection with Beur P. S. Case No. 297 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

This petition stands allowed.
