The petitioner being the father of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 304B and 120B/34 of the Indian Penal Code.
The prosecution case is of killing the daughter of the informant for non-fulfillment of the dowry demand by causing burn injury.
It is submitted by learned counsel for the petitioner that the thrust of accusation is against the wife of the petitioner of pouring kerosene oil and litting fire. The petitioner is a driver at Samastipur and hence, he was not present at the
Patna High Court Cr.Misc. No.6624 of 2016 (2) dt.12-02-2016 2/2 relevant time. The marriage was performed in 1999 and during investigation the informant has conveyed this fact to the I.O. Moreover, the victim was provided medical assistance at Apollo Burn Hospital.
Considering the thrust of accusation against the mother-in-law and husband of the victim, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna in connection with Athmalgola P.S. Case No. 225 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
