JUSTICE MIHIR KUMAR JHA ORAL JUDGMENT 13-02-2015 Having regard to the fact that the respondents in the counter affidavit have explained that all the admissible and payable retirement benefits, as per the paying capacity of the university, has already been made to the petitioner, this writ application must be held to have become infructuous. It is, however, recorded that certain amount, which has been admitted in the counter affidavit, but its payment has not been made on account of non-release of fund not only to the petitioner but to other employees of the university, the payment thereof shall be also made to the petitioner as and when such payment is made to others in the university and, of course, by

Patna High Court CWJC No.1728 of 2014 (5) dt.13-02-2015 2/2 maintaining a priority list on the basis of the date of retirement of the employees of the University.

With the aforementioned observation and direction, this writ application is disposed of.
