JUSTICE KISHORE KUMAR MANDAL ORAL JUDGMENT Date: 05-09-2016 Heard the counsel for the petitioners and the State. It is stated that the subject land measuring a total area of 02 acres was permitted to be settled with the petitioner(s) vide Settlement Case No. 233 of 1988-89 (Annexure-3). The respondent-Circle is not permitting the mutation of name of the settlee(s) and thereby accepting the land rent against the rent receipt. It is further argued that with an identical grievance another writ petition was filed vide CWJC No. 20856 of 2013 which was disposed of permitting the petitioner to ventilate his grievance before District Magistrate. A web copy of the said order has been handed in by the petitioners which is taken on record and marked 'Y' for identification.

Having regard to the said submission, the present writ petition is also disposed of permitting the petitioners to file a comprehensive representation

Patna High Court CWJC No.3151 of 2014 dt.05-09-2016 2/2 within 04 weeks before the respondent District Magistrate along with a copy of the order. If any such representation is filed, the respondent District Magistrate shall either himself or through any other competent authority shall get the grievance of the petitioners examined and appropriate decision taken and/or appropriate order passed thereon in accordance with law after giving an opportunity of hearing at an early date, preferably within a period of 03 months from the date of filing of the presentation.
