2. The petitioner has moved the Court under Section 482 of the Code of Criminal Procedure, 1973 for the following relief:
"That this is an application under Section 482 of the Code of Criminal Procedure praying for quashing of the entire criminal proceedings, arising out of the Spl. Case no. 48 (A)/2011 pending in the court of Special Judge Vigilance (Trap), Patna arising out of Vigilance P.S. Case No. 86/11 dated 05.12.2011 u/s 7, 8, 13(2) read with section 13(1) d of P.C. Act and later on added section 10 of the P.C. Act including the order taking cognizance dated 31.07.2014, passed by Special judge Vigilance Trap Court, Patna against the petitioner under section 7, 8, 10, 13 (2) read with section 13(1) d of P.C."
3. After some arguments, learned counsel for the
Patna High Court CR. MISC. No.8239 of 2015(2) dt.22-04-2019 2/2 petitioner submitted that he may be permitted to withdraw the application with liberty to file an application before the Court below itself, at the appropriate stage.
4. Learned counsel for the Vigilance does not oppose.
5. In view thereof, the application stands disposed off with liberty aforesaid.
6. If such an application is filed by the petitioner before the Court below itself, at the appropriate stage, the same shall be considered on its own merits, in accordance with law, without being prejudiced by the present order. (Ahsanuddin Amanullah, J) Anjani/- U T
