The petitioner seeks bail in connection with Imadpur P.S. Case No.48 of 2016, registered under Sections 363 and 366(A)/34 of the Indian Penal Code.
The accusation is of kidnapping of grand daughter of the informant by this petitioner in connivance with his other family members.
Learned counsel for the petitioner submits that, in fact, the petitioner, who is co-villager of the informant, has falsely been implicated in this case due to dirty village politics. Further submission is that, in fact, victim was recovered by the Police on 17.10.2016 at Bihta stand, as detailed in paragraph No.21 of the case diary and thereafter, her parents were
Patna High Court Cr.Misc. No.20918 of 2017 (2) dt.12-05-2017 2/2 informed, who also came there, but under pressure the victim gave her statement under Section 164 of the Cr.P.C. about her carrying by this petitioner forcibly from Dehri to Sasaram and from Sasaram to Banglore and parents of victim received her from Banglore. The petitioner has no criminal antecedent is in custody since 19.10.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Bhojpur Ara in connection with Imadpur P.S.
