The petitioner seeks bail in connection with Kahalgoan P.S. Case No.296 of 2016 registered under Sections 47, 53(B) and 54 of the Bihar Excise (Amendment) Act, 2016. The accusation is that in course of checking of the vehicle, the motorcycle of the petitioner was searched and, in that course, 230 pouches, each containing 200 ml. country made liquor, were recovered.

Learned counsel appearing on behalf of the petitioner submits that the petitioner having no criminal antecedent is in custody since 01.09.2016.

No.8176 of 2017 (2) dt.10-03-2017 2/2 Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Kahalgoan P.S. Case No.296 of 2016.
