The learned counsel for the petitioner submits that petitioner is the rightful owner of the land situated in Khata No. 164 appertaining to Plot No. 2412, 2404 & 2325 having an area of 4 Bigha 3 Katha situated at Mauza Mohanpur Panhesa, Circle Silao District-Nalanda. Learned counsel further submits that long standing Jamabandi has been created in the name of petitioner's ancestors. Additional District Magistrate has cancelled the Jamabandi vide order dated 20.03.2018, passed in Jamabandi Cancellation Case No. 29 of 2016. The petitioner has preferred Jamabandi cancellation Appeal No. 43 of 2018 under
Patna High Court CWJC No.6505 of 2025(2) dt.02-09-2025 2/2 Section 9(6)(A) of the Bihar Mutation Act 2011, but the same is pending before the District Magistrate, Nalanda for about seven years.
3. Learned counsel for the State submits that the land in question is public land and the jamabandi has rightly been cancelled.
4. Considering the nature of dispute and the fact that the appeal of the petitioner is pending before the District Magistrate since long, accordingly, District Magistrate is directed to dispose the appeal of the petitioner in accordance with law after given opportunity of hearing to all concerned within the maximum period of four months.
5. The present writ petition stands disposed of with the aforesaid direction.
