JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-01-2022 Let the defects, if any be removed within four weeks of the complete start of the physical Court. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Jehanabad P.S.Case No. 36 of 2018 registered for the offences punishable under Sections 30(a) of the Excise On secret information, 9 liters country made liquor was recovered from village Earki and two persons Somran Manjhi and Bharat Bhushan Bhardwaz were caught on the spot. It is submitted on behalf of the petitioners that their names has been transpired on the basis of confessional

Patna High Court CR. MISC. No.21856 of 2021(2) dt.03-01-2022 2/2 statement of Somran Manjhi. Petitioners are not apprehended on the spot and no incriminating articles has been recovered from his conscious possession. Petitioners have clean antecedent.

Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that above named petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd cum Special Judge, Excise Siwan in Jehanabad P.S.Case No. 36 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
