====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 06-05-2022 Heard learned counsel for the petitioner and learned counsel for the State through Virtual mode.

Learned counsel for the petitioner is directed to remove the defects, as pointed out by the office, within a period of four weeks.

The petitioner is apprehending her arrest in connection with Bikramganj P.S. Case No. 57/2020 for the offence registered under Sections 420, 467, 468 and 471 of the I.P.C.

The prosecution story, in brief, is that the petitioner cheating thereby dishonestly inducing the appointing authority to deliver her appointment letter on the post of Sevika at 'Agan Bari Centre' on the basis of forged mark-sheet of Matric and

No.12208 of 2022(2) dt.06-05-2022 2/3 prepared a forged document i.e., mark-sheet of Matric for obtaining her appointment on the post of Sevika and the said forgery has been committed intending that the mark-sheet of Matric shall be used for the purpose of cheating and fraudulently or dishonestly using as genuine. It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has been made accused in the present case due to mistake of fact. As per allegation, the petitioner is said to have been engaged as Sevika in 'Agan Bari Centre' on the basis of fake certificate. The petitioner had no knowledge that the certificate in question is fake. The petitioner is a lady. She had no intention to commit fraud or cheating. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of
