The petitioner apprehends his arrest in connection with C.R. No. 1068 of 2018/T.R. No. 2582 of 2020 registered under Sections 379, 498A, 420, 494/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. On perusal of Annexure-3, it is evident that the complainant herself declares that she did not want to live with the petitioner and took divorce with the
Patna High Court CR. MISC. No.22066 of 2021(2) dt.28-01-2022 2/2 consent of the petitioner and both the parties have agreed to withdraw all pending cases. Further he submits that the complainant thereafter filed again one case against the petitioner, which was later on dismissed by the learned court below, as contained in Annexure-4.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of A.C.J.M.-IX, Darbhanga in connection with C.R. No. 1068 of 2018/T.R. No. 2582 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
