The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420 and other allied sections of the Indian Penal Code. Allegation against this petitioner is that informant had received a sum of Rs. 50,000/- under Indira Awas Yojana and subsequently, informant found that petitioner had withdrawn a sum of Rs. 49,000/-.
It is submitted that petitioner at the relevant time Branch Manager and so-called occurrence is said to have been taken place on 11.07.2014, but the FIR was lodged on 06.02.2017 after two and half years for which there is no plausible explanation. Co-accused Nurul Hoda having similar

No. 62939 of 2017 vide Annexure-2. Petitioner claims clean antecedents. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Dighalbank P.S. Case No. 08 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
