====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 29-02-2020 Heard learned counsel for the petitioners and learned APP for the State.
Petitioners seek bail in a case registered for the offences punishable under Sections 364, 120(B), 302, 201 of the Indian Penal Code, 27 of the Arms Act and Sections 13, 16, 19, 20 of the U.A.P. Act.
Submission is that the petitioners are not named in the FIR whereas 13 persons are named in the FIR. In the confessional statement of co-accused Rubi Devi, name of the petitioner surfaced and Rubi Devi has already been allowed bail by the coordinate Bench of this Court.
Considering the aforesaid facts, let the petitioners,
Patna High Court CR. MISC. No.13635 of 2020(2) dt.29-02-2020 2/2 above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Patepur Police Station Case No. 224 of 2018, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.
(b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
(c) The petitioners shall not leave the country without permission of the learned trial court.
