The petitioners apprehend their arrest in connection with Bhawanipur P.S. Case No.236 of 2021, registered for the offences punishable under Sections 147, 148, 149, 447, 302 and 120(B) of the Indian Penal Code.
Co-accused, Jaitha Marandi and Munshi Marandi are said to have killed the brother of the informant by means of bow and arrow. The petitioners were also present at the place of occurrence with the accused persons.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the
Patna High Court CR. MISC. No.12265 of 2022(2) dt.03-08-2022 2/2 present case. There is general and omnibus allegation against the petitioners. It is further submitted that specific allegation is against Jaitha Marandi and Munshi Marandi who killed the brother of the informant by means of bow and arrow. It is submitted that the petitioners have got no criminal antecedent as stated in paragraph3 of the bail petition. The learned APP for the State opposed the prayer for anticipatory bail of the petitioners.
Taking into consideration the facts that the petitioners have got no criminal antecedent and there is general and omnibus allegation against these petitioners, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Purnia in connection with Bhawanipur P.S. Case No.236 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
