JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-03-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Jaipur P.S. Case No. 04 of 2019 for the offence under Sections 25(1-b) a/26 of the Arms Act and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

In the instant case total 38 litres of liquor was seized. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the liquor was sized from motorcycle, which belongs to this petitioner. He further submits that in fact the brother of petitioner, namely, Sujit Kumar Yadav, was plying the motorcycle and he was apprehended for carrying liquor. He further submits nothing was recovered from the possession of the petitioner.

Considering the aforesaid, the petitioner named

Patna High Court CR. MISC. No.12450 of 2020(2) dt.06-03-2020 2/2 above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Banka in connection with Jaipur P.S. Case No. 04 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anil Kumar Upadhyay, J) uday/- U T
