Heard learned counsel for the parties concerned. 2.

The present petition has been filed for restoration of a criminal revision bearing Cr.Rev. no. 557 of 2021, which has stood dismissed due to non-appearance of the counsel for the petitioner, vide order dated 27.09.2023.

Learned counsel for the petitioner submits that the on 27.09.2023, when the case was called out, he could not appear in the Court due to mistake on the part of his Clerk, hence, a sympathetic view may be taken and the aforesaid criminal revision application be restored to its original file. 4.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel

Patna High Court CR. MISC. No.29309 of 2024(2) dt.26-04-2024 2/2 for the petitioner as also taking into account the averments made in the present petition, I deem it fit and appropriate to restore the aforesaid criminal revision petition bearing Cr.Rev. no. 557 of 2021, to its original file.
