JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Khizirsarai Police Station Case No. 136 of 2014 registered for the offences punishable under Sections 302, 201, 328/34 of the Indian Penal Code.

Admittedly, none has seen the actual killing of the deceased nor the dead body of the deceased was recovered from the house of the petitioner.

No doubt, in course of investigation, some witnesses stated that deceased had developed sweet relation with the petitioner as a result thereof he was killed by the family members of the petitioner but even if the aforesaid statement assumed to be

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Gaya in Khizirsarai Police Station Case No. 136 of 2014 , subject to condition as laid down under Section 438(2) of the Cr.P.C.
