JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2015 Heard learned senior counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 201/34, 302 of the Indian Penal Code and 27 of the Arms Act.

The son of the informant went outside in the night at 9.00 P.M. but he did not return when his dead body was recovered from the drainage. It is suspected that the son of the informant was killed by co-accused Ram Babu Yadav, Nageshwar Yadav and the petitioner. It is also alleged that the son of the informant earlier gave Rs. 1,50,000/- to Ram Babu Yadav and Nageshwar Yadav but on demand money was not returned. Ram Babu Yadav and Nageshwar Yadav also threatened the son of the informant.

It is submitted by learned senior counsel

Patna High Court Cr.Misc. No.10703 of 2015 (2) dt.17-03-2015 2 / 2 for the petitioner that there is no direct evidence against the petitioner and the petitioner has no concern either with the deceased or Ram Babu Yadav and Nageshwar Yadav with whom victim had some money transaction dispute. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent. Ram Babu Yadav has been granted bail by this Court vide Cr. Misc. Nos. 39010 of 2013.

Considering the suspicious nature of accusation and the fact that co-accused has been granted bail, let the petitioner, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Kusheshwar Asthan P.S. Case No. 04 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Birual at Benipur, Darbhanga, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
