The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324,307, 379 and 504/34 of the Indian Penal Code.

It is alleged that petitioner no. 1 caused injury with Farsa on the head of the informant when brother and father of the informant came to rescue then other accused persons assaulted them. Some accused persons took away the box of the mother of the informant containing ornaments and clothes worth Rs. One Lac.

It is submitted by learned counsel for the petitioners that injury appears to be simple nature

Patna High Court Cr.Misc. No.6840 of 2015 (3) dt.02-03-2015 2 / 2 though opinion with regard to injury no. 1 has been reserved. Petitioners' side lodged a case at earlier point of time and accusation has been levelled in the background of serious land dispute when 144 Cr. P.C. proceeding is pending between the parties. A statement has been made in paragraph no. 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the petitioners, above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Fulwaria P.S. Case No. 129 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M., Gopalganj, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
